Cancellation and Refund policy

These terms represent our formal position on the use of this website and service subscriptions. Please read them carefully before extensively using this site or engaging in a subscription.

Under distance selling regulations you have a 7 working days in which time you may cancel your order and request a refund.

Information services are processed the same day and sent via e-mail

Please allow upto 24-48 hours excluding weekend and public holidays for the processing and activation of any software used. Orders recieved after 10am friday may not be processed until the following monday

Probotuk is a subsidiary of Probetsuk (the Companies) hereby refered to as Probetsuk gives you a non-exclusive license to use the software ProBot.

You the End user maybe granted for a time limited period a license to use the application for evaluation purposes only, before having to pay a monthly license subscription fee,

TERMINATION

The license will terminate automatically if you fail to comply with the limitations described above. On termination, you must destroy all copies of the Software and Documentation.

DISCLAIMER OF WARRANTY

The Software is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the Software is borne by you. Should the Software prove defective, you and not the Company assume the entire cost of any service and repair.

PROBETSUK makes no warranty that:

The software will meet your requirements.
The software will be uninterrupted, timely, secure or error-free.
The results that may be obtained from the use of the software will be effective, accurate or reliable or prone to errors due to the nature of the markets or any other unforeseen situations.
The quality of the software will meet your expectations.

THE COMPANIES ARE NOT RESPONSIBLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR INABILITY TO USE THE SOFTWARE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Title, ownership rights and intellectual property rights in and to the Software shall remain in the Company.
The Software is protected by international copyright treaties.

"IPR" means any and all patents, trade marks, service marks, rights in designs (including semiconductor
topography design rights and circuit layout rights), get-up, trade, business or domain names, goodwill associated with the foregoing, e-mail address names, copyright including rights in computer software (in both source and object code) and rights in databases (in each case whether registered or not and any applications to register and rights to apply for registration of any of the foregoing), rights in inventions and web-formatting scripts (including HTML and XML scripts), know-how, trade secrets and other intellectual property rights which may now or in the future subsist in any part of the world including all rights of reversion and the right to sue for and recover damages for past infringements;

Both parties agree not to disclose this or any information about you or your account to a third party and will endeavour to protect such information to the best of their abilities.

1. DEFINITIONS

In these Terms of Business the following expressions shall have the following meanings save where the context otherwise requires:

“Probetsuk” means the service is operated solely by Probetsuk

"Details" the details which You must provide upon ordering our services including physical address, e-mail address, age, bank account and credit, debit or charge card details via paypal.

"Fee" means the fee shown for the provision of the services inclusive of any applicable sales tax (which where applicable shall be payable by You at the rate for the time being in force in the United Kingdom or the country which levies such tax

"Services" any item produced and supplied by Probetsuk pursuant to these Terms.

"Sale" a sale effected via this site or direct with the operators of Probetsuk.

"Terms" means these terms and conditions between Probetsuk and You.

"Website" means Probetsuk website

“Working Days” means Monday to Friday 9am to 5pm excluding bank, public and statutory holidays.

“You” means the person who is using this site or receiving a service from Probetsuk.

The clause headings and any other headings are inserted for convenience only and shall not affect the construction of these Terms.

Probetsuk gives You written consent to do so the information is already freely available in the public domain and You are able to provide written evidence to this effect

the information was already known to You via another source and You are able to prove this through your own records

All content within any of Probetsuk’s websites or in Probetsuk’s products remain the intellectual property of Probetsuk except where content is sourced legally from a third party and such content is acknowledged as the intellectual property of that third party.

No content found on Probetsuk’s websites or in Probetsuk’s products may be reproduced in part or whole without the express written consent of Probetsuk.

You agree never to use the information you are privy to as a member for commercial gain.

You acknowledge that a breach of nondisclosure and/or copyright may result in immediate suspension and possible termination of your membership.

You acknowledge that Probetsuk will suspend or terminate your membership if it is discovers that your Membership has been misused.

3. ORDERS

In seeking to purchase Probetsuk services via the Website You must provide accurate Details.

You hereby warrant to Probetsuk that You are at least eighteen years of age and legally able to enter into contracts for the services provided

Probetsuk reserves the right to withdraw any services without prior notice and to refuse any orders for our services placed by You.

Probetsuk may send a small file to Your computer when You visit the Website(s). This "cookie" will enable Probetsuk to track Your behaviour on the Website and to identify particular areas of interest so as to enhance Your future visits to the Website. The cookie will not enable Probetsuk to identify You and Probetsuk shall not use it otherwise than in relation to this Website. You can set your computer browser to reject cookies but this may preclude use of certain parts of the Website(s). Probetsuk will not use Your data for any other purposes than as set out in these Terms except that Probetsuk may disclose this data if compelled to do so by law, or at the request of a law enforcement agency or governmental authority.

All orders You place for our services are subject to availability and it is Your responsibility to ensure that Your order is correct.

It is your responsibility to ensure that the service we provide you when ordering are legal in your country of residence.

Any representations of the services shown are provided for the purposes of guidance only.

Due to the nature of electronic distribution of information, services and materials, Probetsuk can not be held liable (whether in contract or tort) for any losses, costs or damages resulting from the use any information or services provided by Probetsuk.

4. PAYMENT

You agree to pay the Fee at the time You place Your order.

Once You have confirmed Your order it cannot be cancelled or changed once the Services has commenced until the subscription cycle has been completed.

Subscriptions are taken automatically on the due date, until cancellation.

In the event that Your chosen method of payment is refused by Your card issuer or Bank for whatever reason, Probetsuk will invoice You for the services ordered and You agree to pay in advance for those services. Probetsuk will not supply its services until such time as your subscription is paid in full (cleared funds).

Non-delivery by any third party shall not give You any right to delay payment to Probetsuk or to make any claim whatsoever against Probetsuk.

WARRANTY AND LIMITATION OF LIABILITY

Probetsuk warrants that services purchased will be of satisfactory quality and fit for the purpose for which they are supplied.

Probetsuk shall not be liable to any person for any loss or damage arising from the use of any Services or information presented on any of the websites, physical documents or data supplied in any form. Should You decide to place a wager with a Betting House, You must first verify the information on which You are basing Your decision is accurate.

Your warrant to Probetsuk is as follows:
That You are fully and legally entitled to enter into this Agreement;
That You have full authority to execute this Agreement;
That Your entering into this Agreement is not illegal in Your jurisdiction and You will not use the Services while located in any jurisdiction that prohibits the use of such Services;
That You are over 18 years of age;
That You are acting as a principal and not as an agent on behalf of a third party;
That all details provided by You to Probetsuk are accurate and that You will not take steps to conceal Your true identity from Probetsuk or any Betting House such as by using pseudonyms, false addresses or taking technical steps to conceal Your identity or location;
That You are the authorised User of any credit or debit card You use for the Services and that You have never failed to honour a liability by dishonestly attempting to charge back a payment made by card for online Services;

Remember gambling is risky and Probetsuk cannot be held responsible for any losses you may incur whilst using their information and software.

TERMS AND PRICING

Probetsuk reserves the right to amend these terms without consultation. If Probetsuk changes its terms and they affect a service you are currently receiving it will invite you to agree to the new terms.

Probetsuk reserves the right to amend its product pricing structure without consultation. If Probetsuk changes its pricing structure and this affects a service you are receiving it will notify you in advance of the change.

You have the right to refuse a service if you disagree with changes to terms or prices.

DATA ACCURACY

Probetsuk makes every effort to ensure that the data records it maintains are accurate but it takes no responsibility for errors that may exist in any data it may make available to you.

It falls to you to maintain your own records of dealings with Probetsuk and any information it may supply you with.

SERVICE CONTINUITY

If you have purchased a Probetsuk subscription Probetsuk will provide you with a service Monday to Saturday, inclusive. Probetsuk may provide a service on Sunday’s. If it intends to do so it will notify you on a Saturday.

Probetsuk rely on third party services. Probetsuk will not be held liable for any disruption or loss you may incur should it be unable to deliver a service to you as a result of a third party service being unavailable to Probetsuk.

Operational difficulties may result in periods of service disruption. Probetsuk will always endeavour to notify you in advance if it believes it will experience operational difficulties.

Probetsuk may schedule periods of significant service outage. These periods will be well planned in advance. In such circumstances Probetsuk will adjust all affected renewal subscriptions to take account of extended periods of planned outage. No further adjustments to subscription fees will be considered unless further unplanned and unforeseen outages occur.

The Probetsuk service researches markets to uncover potential investment opportunities. On occasions no opportunities may be uncovered that meet the quality thresholds implemented by Probetsuk. If no investments are listed on a given day this will not and does not constitute a service disruption, planned or otherwise. No consideration will be given to any claim for a refund or extension in these circumstances.

MISCELLANEOUS

These Terms shall form the entire agreement between the parties and supersede any previous agreement and (save so far as expressly preserved hereby) representations oral or otherwise made by either of the parties. You warrant that You have not relied on any representation made by Probetsuk in entering into this agreement.

Failure by either party at any time to enforce any right claim or provision of these Terms or arising hereunder shall not be construed as a waiver of such right, claim or provision.

All notices to Probetsuk shall be given by You in writing to the email address provided. All notices to You shall be given in writing to Your e-mail address or to the address You have given for delivery of services.

These Terms and Your agreement with Probetsuk shall be governed and construed in accordance with English Law. You irrevocably agree for the exclusive benefit of Probetsuk to submit any dispute hereunder to the jurisdiction of the courts of England but nothing herein shall prevent Probetsuk from taking proceedings against You in any other court of competent jurisdiction.
